The following Company privacy policy (“Privacy Policy”) is designed to inform you, as a user of the Website, about the types of information that the Company may gather about or collect from you in connection with your use of the Website. Changes to this Privacy Policy are discussed at the end of this document. Each time you use the Website, however, the current version of this Privacy Policy will apply.  The Website is hosted in the United States of America and is subject to U.S. state and federal law.  Financial Education and Management, Inc. is the sole owner of the Website, including Personalized Websites. We collect information from customers and visitors to the websites at different points on the websites. Like most websites, we automatically gather information that browsers automatically make available, including: IP addresses; domain servers; types of devices accessing the Website; and types of Web browsers accessing the Website (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you.

 Through your use of or visits to our websites, you may be required or requested to provide personally identifiable information (hereafter “Personal Information”) to us. Personal Information is any piece of information which can potentially be used to uniquely identify, contact, or locate a single person. Such information includes, without limitation: (1) “Contact Data” (such as your name, mailing address and e-mail address); (2) “Demographic Data” (such as your age, gender, profession, education level, relationship status, religious affiliation, country, state, city and likes and dislikes,); and (3) “Financial Data” (such as your credit/debit card number and expiration date). In each case, you will be asked to provide Personal Information; the Website will not gather it surreptitiously. We may supplement the Personal Information you provide with additional personal information gathered from public sources or from third-parties (e.g., consumer reporting agencies) who may lawfully provide such information to us. You are under no obligation to provide Personal Information, with the caveat that your refusal to do so may prevent you from using certain of the features and services available on the Website or from purchasing any of our products.

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

 Our store is hosted on Thinkific as well as others. These company(s) provide us with the online e-commerce platform that allows us to sell our products and services to you.

 Your data is stored through this company(s) data storage, databases and the general application. Each will store your data on a secure server behind a firewall.

 SECTION 5 – THIRD-PARTY SERVICES

 In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

 However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

We cannot guarantee that only authorized persons will view your information. We are not responsible for third-party circumvention of any privacy settings or security measures.


We are dedicated to protect all information on the Website as is necessary. However, you are responsible for maintaining the confidentiality of your Personally-Identifying Information by keeping your password confidential. You should change your password immediately if you believe someone has gained unauthorized access to it or your account. If you lose control of your account, you should notify us immediately.

In no case shall Financial Education and Management, Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

SECTION 14 – RETURN POLICY

 
FEAM products include a limited 90-day new product return policy. Within 90 days of purchase, a customer can return or exchange new and unworn item(s) in resalable condition and original packaging (excludes ‘all sales final’ items, Business Supplies, Stylist ‘cash and carry’ table sales, etc.) with no restocking fee. We will provide you with a refund or credit (your choice) for items returned within 30 days of your original Shipping date and product credit within 90 days. Initial outbound shipping will not be refunded, and customers are responsible for shipping the product back to FEAM.

 
Additionally, if there is a workmanship defect within 90 days of purchase of any item, FEAM will replace it at no charge! Customers are responsible for shipping the purchased item back to FEAM.

 
Please note: the FEAM return policy does not cover lost items or products damaged through normal wear and tear, accident or misuse (breakage due to mishandling, wearing in water, etc.).  The item being returned and or exchanged must be accompanied with a copy of the sales receipt/packing slip and a completed return form. Shipping costs incurred are non-refundable. Refund requests may take around 10 business days to be processed and completed. This does not include the processing time from your bank.

 

SECTION 15 – INDEMNIFICATION

 
You agree to indemnify, defend and hold harmless Financial Education and Management, Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 16 – SEVERABILITY

 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

 
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

 
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 18 – ENTIRE AGREEMENT

 
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

 
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
